Traffic accidents in Taiwan (South East Asia)

I have heard that motor vehicle accidents in South East Asia might be a tricky thing - especially to determine the root cause and making you pay money off records in order to settle. Especially if you are a westerner - people say you better pay the 2nd party whatever they ask and leave.

Why cannot the accident (and therefore reimbursement details) be taken through the court?

Case #1:
You drive a scooter and hit another one. Everything was taped on the dashcam. The accident is light and both passengers might have bruises. But the victim is “playing” a big medical injury with the back and is laying on the road. The victim relatives come and ask you to pay a good chunk of money.

  1. Why cannot this be taken through legal system? With a dashcam, medial results it should be quite easy to assess the injuries.

Case #2:
There was an accident between 2 scooters and you as a 3rd party want to help the injured by moving them away from the heavy traffic (or other). The injured person you touched is sueing you that by helping you have caused some of his injuries.

  1. This seems to be easily disproven by medial assessments as well, no?

  2. Also - if someone else saw the accident and you helping the person - wouldn’t that help the assessment?

  3. Now if the victim that’s “acting” the injuries sees that this is being taken to court and with an addition, that if the victim is found to be lying about this injuries - they will have to cover the legal costs. Wouldn’t it bring a high chance that they will drop the claim due to unceratincy of the result and possibility of personal financial loss?

Is this a legal question or a cultural question?

There are both cultural and practical reasons why people try to settle disputes quickly, but any dispute can be heard in court, unless the court decides prima facie that it’s absurd, or the court lacks jurisidiction.

Don’t know about the situation in Taiwan, but what does it have to do with Southeast Asia? Taiwan is firmly in the East Asian subregion.
