I have a mate who wants to get a spousal ARC. His wife is not Taiwanese. He wants to know if he’ll be able to work legally on this ARC. There’s another twist here however. His wife got married in Taiwan to another chap 2 years back so that he could get an ARC. Problem is, they were never divorced and she says that the marriage was never registered in Taiwan, but that would be impossible as they were married in court here in Taiwan…
Wot u talkin bout?
Pretty sure the answer is no (even if there are no other complications due to the second part you wrote below).
Oh boy.
Bigamy is frowned upon, generally, although the Pogues said it best with:
“Two wives are allowed in the army, boys,
But one’s too many for me!”
But a spousal ARC when neither party is an ROC citizen doesn’t allow the spouse to work.
This situation doesn’t make much sense. But OK. Here’s something else to keep in mind. If she’s still legally married to someone else, that also raises the matter of adultery, which in Taiwan is a criminal offense. Generally, of course, the authorities don’t give a damn. But given a situation that involves foreigners, bigamy, and an ARC scam (the earlier marriage) they might be inclined to take considerably more interest. And that’s without even considering what would happen once the local media got wind of this.
Everyone involved should tread carefully.

Yes, Cranky Laowai, she is still technically married to husband #1 but for some reason thinks that this first marriage which took place in Taiwan, was not registered. I told her that is impossible since they were married in court AND hubby#1 was able to get a spousal ARC because of this union.
Trying to convince her otherwise seems to be an impossible task!
She should get a divorce first.
This whole situation sounds very rotten to me.

Where is the wife from? She sounds mentally retarded.

She does, doesn’t she! Or in extreme denial.
If she applied for a spousal ARC for her husband, she would have been required to provide an official marriage certificate, which means her marriage is registered whether she realizes it or not. She’s looking at bigamy AND possibly adultery charges. Sounds like jail time to me. I’d be keeping my head WELL below the parapet if I was in her shoes.
She’s from South Africa. Afrikaans-speaking. And yes, I’m beginning to think that she is mentally retarded, too.
Even if she does get divorced from the first husband, she’ll have problems getting a spousal ARC for her next husband, I’d guess. Believe it or not, governments take a dim view of people marrying just to get a ‘green card’ or local equivalent. If her first spouse got the ARC, and shortly afterwards she divorces, marries again and the new husband applies for a spousal ARC, this is going to look awfully suspicious. As far as I can see, officials look for any reason to refuse. Obvious fraud is going to be noticed.
Yeah, but if she divorces, the former husband loses his right of abode in Taiwan, no?
Unless they have been married and have lived long enough in Taiwan to get a PARC, that is.

The former husband, (which according to Taiwan’s marriage registry is still her current husband) now has a student ARC so no longer needs the spousal ARC.
They were married less than a year when she decided that her love for hubby #1 had expired, and his spousal ARC did also, after the year was through…
The problem is the government is going to notice that the woman is marrying, sponsoring ARCs and divorcing rather quickly, so they will be suspicious and figure she is just marrying to help some guy get an ARC. In which case the government will refuse to grant this ARC.
What could happen to hub #2 and the woman?
Hub #2 won’t get his ARC. Wife will get “investigated.” She’s a foreigner, right? She stands a really, really good chance of getting hauled up on charges – fraud, etc. Fraud carries big penalties. Remember, too, that adultery is a criminal offence, so its not dependent on an aggrieved spouse pressing charges – the prosecutor’s office will be only too happy to bring charges against her.

Why does the plot thicken if she’s from SA and Afrikaans-speaking?
I’m joking, of course, but Afrikaans is a bit of retarded language.
Like Old Dutch, y’see.
Slow to develop, and even worse to disperse!

Hahahaha! I’m beginning to agree with that!
Another development is that the woman has since become so pissed-off with me at my insistence that she really IS still legally married to hub #1 that she wants nothing more to do with me!! Oh brrrrother!! haha!
