Can they fire me just before I leave?

I filled some papers with them a few weeks ago that state that I will quit the company in this end of this month. This paper was needed by the paperwork for the working permit of the company where I will go, and his now in the hands of the government that is now processing the work permit.

My company is very frustrated that I quit for another one. They first asked me to sign a contract to work for them during the weekends to finished a project, since they didn’t found (they didn’t started to search) somebody to finish it after I leave. I refused, and now they told me that they propose me to not work and not be paid for this month. I also refused because :

  • I need my salary to live.
  • I need to finish some parts of the project or they won’t be able to finish it.
  • I think they want to fire me before the end of this month and try to kick me out of the country before I can smoothly transfert my ARC to the other company, and to accept their strange deal might be a way for them to easily fire me when I am not at the office.

My question is :
Can they fire me like that, by pretexting that I often came late the last weeks (I was busy with papers for the other company), even after they signed a paper that say that I will leave in the end of this month ?

Well, were you late or not?

If you’re taking them for a ride, and I’m not saying you are, then they should bloody well fire your ass. :wink:

yes, that’s true, I was often late lately.
Clearly, my motivation for my work with them have vanished …

The question are :

  • Can they fire me even after they signed a paper that say that I will leave at the end of this month ?
  • If yes, should I leave the island and my ARC will be cancelled, even if the government is processing my next work permit ?

Also, recently I convinced my manager that it was a bad idea to fire me since they need me for their project, and I didn’t do anything wrong with them except that I want to leave their company so that they should not be angry like that. However, I am afraid that they are bad enough to fire me 2~4 days before the end of my contract. Is it legal if they do that ?

My situation is very similar, but in my case I quit my job, giving them the correct notice, but the old boss refuses to accept it in some perverse way she chooses to ignore what she doesn’t want to see.
I will serve my notice as I expressed in my resignation letter, but I’m doing my utmost to fulfil my obligation, even if everyday is a grind. This is a good idea if you intend on staying in Taiwan as well as giving the next company some idea of your following through power. People here have very long memories.

My question is similar though and it is:
If the government is processing my next work permit, do I have to leave the country?

Please see the “Fired for no reason thread.” They have to fire you for cause (or pay severance) and being late is not an acceptable reason. If you miss three straight days of work or six in a month without notifying you, they can fire you.

Tell them you are going to the labor arbitration board. That should help.

It would be pointless firing you so near to the end of your contract; it would also mean they’d have to pay you severance pay, so I would relax if I were you.

If they do, you’ll get some bucks out of them through arbitration/the courts.

Two of you have asked that. I am almost certain the answer is “no”.
