Murder is against the law. So that part is easy and out of the way.
Hate crime was intended. Hate crimes are also illegal. But— right? If you want to buy weed and do so and are arrested and come to find it’s oregano, are you guilty of buying weed or solicitation of being weed?
So hate crime? Maybe not. Intention to commit a hate crime? Probably yes. 
Why not just buy weed and think racist thoughts? 
You may have heard about pedophiles who have never committed pedophilia, only fantasized about it. Some are coming out online about their sexual preferences. What to do about them? Should we lock some people away for thoughts in their heads?

They should just STFU about it, but never acting on their feelings is virtuous. One might not agree about that, but we’re not going to have thoughtcrime anyway.
