Chinese New Year Pay

I’m hoping that someone can help me with some information.

My boss has said that she will not pay me holiday pay for Chinese New Year.
Can she do this? I thought CNY was a national holiday and all employers must pay employees for these days. I’m pretty sure that I’m in the right here. Can anyone send me a link with the law regarding this in Chinese, so I can put it down in front of her and say “read this”.

Are you an English teacher? If you are and are paid hourly, then no, your boss is under no obligation to pay you over the CNY holiday. If you’re a teacher and are paid a monthly salary, then yes, you should get paid for the CNY holiday.

This is how it’s always worked for me for salaried jobs. Also, it depends on your contract as well. It’s in my contract that I get paid for all national holidays, including CNY.

yes, I’m an English teacher, employed full-time. There is nothing in the contract to state that I will get paid for CNY. However, there is nothing stating I won’t. She verbally agreed to pay CNY if that means anything.

As bushibanned said, if you get paid hourly then you will not get anything for time when you aren’t teaching. If you’re on a monthly salary, then you should get your regular pay.

It means sod all, especially in Taiwan.

yeah i thought so. If i’m employed full time I get paid normal wages over CNY. Do you guys know of any site I can go to to find out more info on this? Maybe a law that states if you are employed full time you get paid over CNY
