How do I get a copy of my contract from my last job? I worked for a bushiban in Taipei city. The old employer was very devious and wormed her way out of giving me a copy - now I need it. I remember going to Taipei City Hall or somewhere to apply for my work permit.
Hi,
To expose dubious employers like this, just go to the labor office and file a complaint. They do take complaints very seriously and they do want people to bring up issues boldly. Once you do this, they will deal with the employer and you will get what you need to get. I faced a similar situation and got what I needed.
Regards.
First you contact the Education Ministry in Taipei City, I was able to obtain one from Taoyuan when I worked there, however I had to push them to get it. They must provide it for you! You should also contact your buxiban by email so you have a record of the coorespondence with them. They also must, under the law, provide you with a copy when both parties sign it. Most don’t and it’s illegal. It is actually best to get a copy from both places. I found my contracts were different, the one I signed and the one on file with the Education ministry was different, it’s too bad I didn’t have more proof otherwise I would have sued.
If you cannot obtain a copy from either seriously consider talking to Richard Hartzell about suing one or both parties, process may be long, but it would benefit all of us.
You can also make an appointment and file a complain with the CLA in Taipei City, they will arrange a meeting between you and the school and they will sit as the moderator, this is great proof of what has been done and what has been said between both of you. You may want to file a complaint anyway so the CLA has a record about the school on file. This is particulary helpful if other people have similiar problems like you. If they get enough complaints they will launch their own inquiry.
