My friend is in a difficult situation. She has been living in India for the past few months apart from her Taiwanese husband who is based in China at the moment. They both want a divorce.

As she is not Taiwanese her husband has told her that he does not need her input in regards to the divorce. Is this even legal? I thought that she would at least need to sign something.

Can the divorce go through without her knowledge? Is it better for her to go to Taiwan to file for divorce in person?

What is the best way to get a settlement? Should it be settled between the two of them, outside of the courts? If not I presume that she would need to be present in Taiwan for any court proceedings?

Please help, my friend is in desperate need of guidance. Also, does anyone know of a decent Taiwanese divorce lawyer.

I needed a chop and to be present for mine.

They do it at the local hu zheng shi wu suo.

I have a hard time imagining that you can do it without being present.

Any Taiwan family law specialist should be able to help you - get their advice and get a settlement outside of the courts, based on what the lawyer tells you to do.

Does anyone have a name of a good Taiwanese Family Lawyer? Thanks. Can I get other peoples opinions as well? What do you mean by the chop?

What are the grounds for divorce ? I imagine in cases where one person refuses to come it can it done without them.

If the Taiwanese partner has to show abandonment, you are looking at actually proving that they have lived separately for x amount of time, and that’s not easy. It’s a multi year process.

A chop is a small stamp with your Chinese name on it. It’s used in the far east as a substitute for signatures.
