Let him take taxi to the garage on one of his days off. Some garages do body work on Saturday. I hit a taxi before too. I paid him a couple thousand on the spot.
If the party not at fault of the accident has not been injured, they have not much pressure to force other party to settle, to compensate beyond damage to the vehicle. Need to file lawsuit on own cost at first and it might cost more than one might get out of it.
If there were injuries here is how to force them to settle:
For six month after an accident one can file a police report for them negligently causing injury. Ask them to settle covering your costs or you would file a police report. This would cause the public persecutor to file chargers. Based on injuries the sentencing might be just a few weeks. But this will go on their criminal record.
Best thing is this will not cost the victim anything. If the other party gets convicted this also can be used to file a civil lawsuit easier.
So the other party is more inclined to settle instead of possibly going through two lawsuits.
Asking for a friend, accident her fault and other party said they got hurt and went to hospital. Asking large sum for damage, injury, lost wages, or will sue. Friend has extra insurance. Insurance will not pay until police deliver final report and then said probably only pay 60-70% of what is being asked and only if other party agree to sign agreement. Insurance say need to go to court at that point. What should friend do?
Go through mediation and go to court, get all receipts and everything for their own expenses as they will be played off against the other persons expenses and get legal advice ask their insurance company who they recommend.
