If it was New York, you wouldn’t have to go to Ximending to see graffiti. You’d see it on the side of your company, apartment building, and probably your car. I am always amazed at the incredible lack of graffiti here, when compared to places like Melbourne (Australia).

Here we are 12 years later and I have noticed a lot more recently.
I have no issues with graffiti artists in designated places doing their thing. But doing it on walls and shuttering, etc., makes the place look like a shithole.
What can a perpetrator be charged with and what kind of punishment would they endure?
Late last year I happened upon two foreigners in Gong Guan writing their Graffiti nonsense on a wall at around 7:00pm. Many people passing by. I said sarcastically that what they were doing was great. They didn’t say a word and left.

如果塗鴉內容涉及毀損他人名譽,或恐嚇公眾安全,則前者觸犯刑法第三百一十條妨害名譽罪;後者觸犯刑法第三百零五條恐嚇危害安全罪,兩罪都是最高可處兩年以下有期徒刑。
如果塗鴉內容只是單純畫畫,沒有特別意義,則視塗鴉處所在位置各有處罰,如在祠宇、教堂、墓碑或公眾紀念的地方或設施塗鴉,依社會秩序維護法第七十三條第四款規定,最高處以新臺幣六千元罰鍰;如果在他人的住宅題誌、店鋪招牌、交通工具、圍牆、房屋或其他建築物等塗鴉者,依社會秩序維護法第九十條,最高處以新臺幣三千元罰鍰。
另外,遭塗鴉而汙損的建物或設施所有權人,還可依民法第一百八十四條侵權行為之規定,請求損害賠償。
