Ok guys I am in big trouble here and I might lose the house that was left over by my grandfather, well I am ABC and my grandfather left a house to me and my brother, each 50% for house and land, but now brother wants to sell the house and have asked court to auction it off, and the law in Taiwan is that they don’t like you to own 1/2 of a house so court will favor my brother which is to auction it off, so now I can either settle it before court and buy it from him (probably market value) or before court auction it off they will ask the property owner if they want to buy it, and in that case court will have an evaluator to see how much the house is worth, I am hearing that the value will be less when it’s the court evaluator is that true? just how low? could it be higher than market value? whichever is lower I am willing to spend a little more to buy it from my brother, help me out guys I got many memories from this house, definitely don’t want to let it auctioned off.

I suspect with any scenario in which you and your brother are not actively negotiating your own price (e.g. “an auction or a court evalulator” as you put it) you’re likely to get considerably less than market value, unless you get very lucky. Since you want to keep the house, you need to evaluate it’s market value. You can do this easily in one of two ways: (1) search one of the many online real estate sales websites in Taiwan for houses of similar age, ping, and location in the same area and find out the average price for similar places the area; (2) engage a real estate agent in Taiwan to do the same: (3) tell us all the information in point (1), plus whether there are any downsides such as water leakage or other damage in the place, and maybe someone on this forum will be so kind as to do the research for you (I’m not online much lately so don’t count on me following this thread). Once you have an idea of the going price, offer your brother something in the ballpark.
Houses at court auction usually fetch quite a bit less than they will sell for on the open market. You may want to get a local real estate agent to value the property for you. Another good method is to ask a bank for a loan for the property as they only loan based on what they think is the market value, rather than what you ask to borrow.
ok the judge and both of us agreed to have 房地產鑑定師, it’s pretty accurate and fair I believe? I heard it costs like 40,000 to 50,000 NTD for it! since the court appointed to that I guess it will be ok.
is it possible for them to also 鑑定 how much the house will be if we auction it off? like in a rough ballpark. maybe how many similar houses near me that was auctioned off and they can do a comparison?
