I have a question. How does one appoint an ‘out of family’ (in fact of different nationality) person as a legal guardian to your child?
consult a lawyer…some friends I know that are the stepfather have been granted legal guardian status due to the mother having legal custody, that way is pretty straightforward, as for your predicament, that would be worth the consultation fee at a law office…
hmm… i would need a reliable lawyer’s contacts in that case! i dont know any lawyers here.
we have free legal counsel here at tamsui service center, i can take you there, friday 9:30 to 11:00 am
Article 1092, Taiwan Civil Code
Changing guardianship permanently is also possible.
Article 1094-1
When electing or changing guardians, for the best interest of the ward, the court shall take everything into consideration; the following things shall be paid attention to
(1) the ward’s age, sex, willingness, health, and the need of developing the ward’s personality.
(2) the guardian’s age, employment, personality, willingness, attitude, health, finance, and criminal records.
(3) relations between the guardian and the ward or relations between the ward and others living in the same household.
(4) when a juristic person is the guardian, the category and content of its business; and relations between the juristic person and its representative and the ward.
You may not need a lawyer. An acquaintance of mine was granted temporary guardianship to take a minor to the states for two months a few years ago. The legal guardians (parents) cooperated and it was not a difficult process.
If you are inquiring about permanent guardianship, you should consult a lawyer.
Thankyou so much everyone.
apparently a handwritten will with or without witness signature is valid in taiwan as the one with the help of lawyer!
I did talk to a lawyer too and expenditure was supposed to be around 50K NTD.
