I was just wondering if there are any documents I can find on the internet that literally and legally states that kindergarten is illegal. I just want to have a copy to to backup my principle of why I don’t want to work kindergarten if a school tries to get me to. I can’t seem to find any so far…
Ok. ok it sounds silly, but I just think it is something that I would like to have on me.
Before you start work you sign a contract that specifies the kind of work you will be doing. If they’re not willing to include the phrase ‘no anklebiters’ then don’t sign it.
The process of negotiating this should make it clear, in a non-confrontational way, that if they subsequently ask you to teach kindy that you will refuse. If they have any intentions of trying to renegotiate later then this should discourage them from hiring you in the first place.
If he were dutch it wouldn’t matter what the contract says … it’s illegal anyway
In any case it doesn’t matter what the contract says – English teaching in kindy, outside of certain very limited parameters regarding time/work permit status/nationality/professional qualifications, is illegal anyway.
OP should know that it’s unlikely that a buxiban will compel a teacher to teach kindy. Most aren’t in that business anyway. However, If they have an attached kindy, letting them know ahead of signing that you won’t teach kindy should suffice. The owners of kindies, I’ve found, are aware of the legalities, btw. No need to show them.

There’s a Tealit.com Web page that links to a page containing a pair of scanned documents that Tealit says are orders prohibiting foreign workers from teaching kindergarten. The documents are in Chinese, and my Chinese is not good enough for me to be able to tell you exactly what those documents say.
If you have a work-based ARC, then the penalty will be like any other illegal work - you get deported and banned from re-entering the country for a number of years (and possibly pick up a fine too).

And what if you have a marriage ARC?
That’s something I’ve been wondering also Chicken. I guess you may just get fined, but what if (huge what if) you got caught 2 or 3 times? I’m wondering what their tolerance level may be if they even have one or would just keep fining you.
I’ve heard the rationale behind this law - that young children learning English from foreigners won’t learn their mother tongue correctly. This boneheaded law was written by people who have no understanding of childhood language acquisition…or else they just have something against foreigners.
But what about the fact that most foreign English kindergarten “teachers” in Taiwan aren’t actually teachers at all, and have no formal training in childhood education…I would think that maybe this law is more about damage control than anything else. Hey, if I had a little kid, I wouldn’t want them being taught by any of the foreigners I knew who were teaching kindie in Taiwan. The thought itself is simply scary.
