Preschool at kindy: legal or illegal

Ok, experts. I think it’s pretty clear. I’ve done everything legit and signed a contract with a kindy as a preschool teacher. I’m guessing that I’m illegal. Right, or wrong??

Hard to say without seeing the contract. You think you signed with a kindie, but it’s probably a Buxiban pretending to be a kindie. The Buxiban can hire you legally, but it probably is not qualified to offer English classes to pre-school children. It is definitely not allowed to ‘loan’ you to a legal kindie conveniently owned by the same people.

I don’t think you are danger of getting deported, but your employers may get fined and decide the whole thing is not worth bothering with. Then again, they may be making so much loot, they don’t care if they get fined.

I would sit tight and not worry too much. This state of semi-legality has been the norm for the 15 years I have been in Taiwan, and I would guess that some arrangement will be made by which your status will be legalized eventually.

Do keep an eye on the situation–if the MOE really does start enforcing all these rules on kindie teaching, schools may stop hiring and lay people off. But by then there may be more opportunities in the regular schools.

The buxiban’s business licence will be invalid too, and if you’re teaching in a kindy but your ARC says “buxiban” you’re in violation of immigration laws. That’s just the way it’s done here, I wouldn’t worry. The “laws” here are just for show. Nobody pays much attention to them and the more restrictive ones are viewed as a minor inconvenience.

I was working at a kindergarten in Hsing Kang a few years back that had 400 students.

Kindy was raided by Foriegn Affairs Police… asked me if I had an ARC… No I said…

Asked me if I had a Visa… NO I sad…

wanted to take me away… I told em to go chase foriegners and gave them my ROC ID Card… they took a copy and went away…

Turns out a school down the road that I they didnt like me cause I refused to work for them… hehehe…

You may be warned not to teach in Kindy’s… just carry your ARC with you at all times and plead ignorance saying your boss / agent sent you to work there… you’ll be OK

If they don’t catch you teaching or anything, just say that you are there observing and learning Chinese the way Taiwanese do. Say one of the teachers is your student and she organized for you to be there to watch. It may work.
