I always insult someone by wording.it as a question. Are you stupid? Just a serious question as i am sincerely concerned about their mental situation, eye sight, hearing, driving capability and etc. So far, not sued. The laws here on these points are quite dumb and some greedy people act on them unfortunately. Or: Do you feel the laws here are quite dumb? How many greedy people have you seen acting on them? ---

yeah, but the USA reports did say they are quite concerned with Taiwan’s defamation laws. The comment the guy made on Chen’s Facebook was quite absurd and that of a playground insult, having the guy locked up over it is a bit much. I really don’t agree with it. Didn’t think Chen would be that thin skinned. I understand why the laws are there, but I mean come on…the comment was insane and the response to it was equally insane. Calling Chen a laptop of the USA is comical tbh. ---

In any case, I think it’ll backfire. People will see what kind of person he is. ---

I agree with mocking the narrative and debating and presenting the facts. But baselessly harming someone’s reputation can go two ways. Either we let people say what they want without impunity, so people are going around calling each other child rapists to get a leg up over the next election or argument or whatever. Or we have some limits to speech like this that harms other people. Chen has never said don’t challenge the government and in fact actually stated that it’s only the defamatory stuff against him personally for the reason. He has explicitly came out in support of the person’s ability to challenge the government’s policies and narrative. You are free to challenge or agree with the government’s narrative, which is exactly what you wrote. I agree with that, but balancing free speech with defamation and other speech that can hurt or violate the rights of others is not an easy task. ---

Actually a true democracy would not imprison or sue someone for criticizing. If that was the case in the US or UK nearly everyone would be in jail or in the courts. If he would have falsely accused him of being a rapist or something then yes. That can damage his character and his credibility to do his job. But from what I see this particular situation is pretty WACK and very not freedom of speech oriented. Yikes ---

Yikes In Taiwan, that can, because of the asian concept of face, be harmful to character. The man did not criticise, he insulted. The man is not being charged for his criticism, only for the insults to Chen’s character. ---

But the guy didn’t actually do that - and the thing is, even if he had, it would have been absurd; it might have been hurtful, but it wouldn’t have “damaged Chen’s reputation” because anyone in their right mind would see it for what it was: the ravings of a crazy person on the internet. In the case of a more serious accusation - say, a concerted campaign in the press asserting that Chen has done something unsavoury - well, in most countries, in order to be defamatory, the _accusation must be false_, or at least unsupported by evidence. This is not (as I understand it) the case in Taiwan. It’s enough to show that the comment is harmful. The truth, or otherwise, is irrelevant. It would be pretty funny if the entire charade did, in fact, turn out to be something to do with pleasing the US government.
