I would like to know if anyone can enlightened me about the differences between a certificate delivered by the ROC and the Taiwanese citizenship. And also explain to me the "Article 2
A person shall have the nationality of the ROC under any of the conditions provided by the following Subparagraphs:
His/her father or mother was a national of the ROC when he/she was born.
He/she was born after the death of his/her father or mother, and his/her father or mother was a national of the ROC at the time of death."
My grand-father was not born in Taiwan, and never lived there but in Canton, then immigrated in my country of birth where back then there was only the ROC consulate (and not a PRC embassy) who delivered him a Nationality Certificate does that mean he is a ROC national and can he pass his nationality on his children? Or is he a PRC citizen, as he was born in China?
As you have proof of ROC nationality in the form of a document issued by the ROC your grandfather can pass his nationality down to his children. However as his old hukou was in the mainland, you would be a NWOHR. Hopefully someone can enlighten us on what the process is for a NWOHR who didn’t naturalise and doesn’t have relatives in Taiwan to get household registration.
My understanding is that as a NWOHR, regardless if you have relatives that are Taiwan citizens (have ID/hukou), you still need to apply for an ARC and live in Taiwan continuously for 1 year (270 days a year for 2 years, etc.) before you can get an ID/hukou. There was talk of giving automatic citizenship to NWOHR back in 2015, but I can’t find any info that it was made law.
Correct, its called a TARC (Taiwan Area Resident Certificate). It looks exactly like a normal ARC but doesn’t have a passport number linked to it since you are a national.
