the last month, i have been under the supervision of a new director who i had many disputes with and i have him a one month notice of my resignation which he conveniently forgot and then after i left he informed me that he had fired me and cancelled my ARC without my signature…and he also said he wrote comments on the cancellation form on how bad of a teacher i was…i have already found a new job…and they are in the process of applying for a new ARC for me…will this be a problem??? will they even see that cancellation form or comments? Thank you

If they cancelled your ARC, then the new school will have to send the paperwork overseas, which means you get to leave the country. I would check with the ARC people and see if your boss got you blacklisted. Probably didn’t, but it’s best to be sure.

If the new employer has already applied for a work permit then the poster should be able to apply for a 30 day extension of the ARC as long as ‘must leave by’ date in the cancellation notice hasn’t yet been reached. If the work permit is granted then the poster can go in to extend the ARC.
As far as the legal issues, an employee can be fired ‘for cause’ for legitimate reasons and regardless of the reason for the employment being terminated, the employer MUST notify the CLA that employment has ended and the ARC cancellation process MUST be started. This would apply regardless of whether the employee quit or was fired or laid off or whatever. Employment ending results in ARC cancellation starting. Only way around it is to get a second work permit in process first or before the leave-by date is reached.
However, just because the previous employer says that the ARC has been canceled doesn’t mean that it actually has been. Once they submit the paperwork to the CLA it takes a while for the work permit to be canceled, the NIA notified to cancel the ARC, and then the notice issued giving 14 days to leave. If a new employer is actually already lined up then it should be no problem to get the new work permit done before having to leave or an extension applied for.

OK back to original point - employers don’t issue ARCs and similarly they can’t cancel them. What they can do is inform the government department that issues ARCs (used to be the police) that you have been absent from work, in which case the government department can cancel the ARC and should then inform you that they have done so. However, if you think there was something unlawful about your dismissal, I should think you should be able to challenge the cancellation of the ARC if indeed it has been cancelled. If you have been working for an employer for more than six months, the employer has to give you notice of dismissal. In addition, there are special regulations protecting foreign workers in this respect. Basically employers need the government’s permission to employ foreigners, but the flip side is that they also need the government’s permission to sack them. I don’t have the details to hand…maybe someone else could fill us in.

Not quite. Employers have to follow the same procedures as terminating a citizen’s employment. The only new protection CLA has set up is a mechanism where foreign workers terminated prior to the end of contract can make a report of any work irregularities at the airport before they depart which the CLA will supposedly follow up on.

I have read about this type of shit happening so many times. Wouldn’t it help to buy the police a few 12 packs of beer and get to know them.
I was also wondering if I really want to take my 5 year visa and get rid of it for an ARC if shit like this is going to happen. Hell I can pay 65 USD a month for international health care. Plus I don’t mind not paying tax or being under the scrutiny of a shitty employer. Whats that you don’t like me?
