My friend is a foreigner.
He is married to another foreigner.
He has an ARC through our company.
His wife has an ARC through him.
His sister wants to come to Taiwan.
The way he wants to do this is as follows:
His wife has a medical condition that is sometimes debilatating
His sister has offered to help them out by taking a year off and coming over to help and keep her company ( they are pretty good friends also). She does not really need to work to make income in that time. He also could cover or be a sponsor for her if she needed any cash
He is then wondering can his sister ( through proof of relationship i.e birth cert etc) and the fact that his wife needs some care ( proof with medical certs, proof of a diagnosed condition), justify to the BOCA/MOFA that they should give his sister a residence visa/ARC. Else is there a provision in the JFRV ( that applies to foreigners) that would grant her the right to Join her family in Taiwan?
2 and a half years on, and no answer… anybody? I’m in a similar situation now… I would like to possibly bring my mother here… I am married and am currently on a 3 year JFRV
Surprisingly neither the “Immigration Law” or the “Enforcement Rules of the Immigration Law” specify what is the meaning of “family” when specifying that residency may be granted for the purpose of “joining family” for foreigners. (It does specify various qualifying family members for non-resident nationals though in different situations.) In fact, the term isn’t even mentioned until you get down the the “Enforcement Rules of the Statute Governing the Issuance of Visas in Foreign Passports” and even that doesn’t specify what constitutes family. Usually the requirement is a spouse or direct lineal relative, which would preclude sponsoring a sibling, but there is nothing in the law which defines this explicitly. Nor does it specify whether one with a “joining family” ARC may sponsor another family member.
The competent authority for interpreting the “Immigration Law” is the Ministry of the Interior, though the “Statute Governing the Issuance of Visas in Foreign Passports” grants the authority of granting resident visas to the Ministry of Foreign Affairs.
