Switch my ARC?

I just got a new job and with it an ARC. But I hate the new job with a passion. If I find something better could I switch my ARC to the new school?

This is what I am thinking.

  1. Go find a new job and ask them to apply for my ARC

  2. Once I get my ARC through them, then go to switch my ARC to the new company.

  3. Go tell my current employer that things aren’t working out and that I found a new job.

I guess I have a few questions.

  1. Is it possible to do this?

  2. If so how?

  3. Could my current employer (the ones I would be quitting with no notice) take any legal (get me deported) action?

I have just been through this process.

  1. According to the labour law, you are allowed to have more that one school on a single ARC. What you do is get your new school to apply for a new work permit. As soon as this has been granted, you can resign from your old school. That way, there is no need to leave the country and come back.

  2. Under NO circumstanses should you try and leave without giving notice. Even with a new work permit, this might get you into trouble. If your old school sends a termination advice to the CLA stating that you have absconded, the CLA has the ability to also cancel your new work permit! :astonished: If there is a notice period specified on the contract, abide by that, otherwise a 30 notice, in writing, should be OK.

  3. ALWAYS send your resignation letter via registered post. If you don’t do this, your old school might turn around (like in my case) and say that they never received a resignation letter from you and list you with the CLA as having absconded, even though you worked out your full notice period! Believe me, it takes a lot of evidence and interviews and other crap to get out of a mess like this.

I hope this helps. Most of the guys in this forum has a lot more knowledge about this. IMO, don’t run, it might come back to bite you.

The previous poster is 100% on target. I had worked for an employer for over 2 years but found a better paying job. I had not signed the new contract yet with the old school but my work permit and ARC had just been granted. With that in hand, and my health certificate fresh, I got the new employer to add themselves onto my ARC with a new work permit. It took about one week to process, I went to get the new stamp in my ARC from FAP and then gave written notice to my old employer. If they had gotten their knickers in a knot before the new school was added, I would have to do the damn HK run. This way was neat, clean, inexpensive and it all worked out great. I had some vacation time coming from my old school and I even got that pay. All in all, try to CYA and be fair with your old school - at least as fair as they will allow you to be.

    Since you already have an ARC you don’t have to apply for a new one. As the posters above noted, you just need to have your new school added to your present one.

You do have to continue working for your current school and can’t violate your contract or your former school will have ways to make life tough for you. The above posters give good advice.

If a persons place of employment files a report with the Labor Bureau what exactly does that mean? Can you ever get another job here again? If you leave and come back can you get a job?

The reason is that I think I might go insane if a have to work in that school again and ever have to deal with my boss again. She is a total idiot. She has the worst people skills on the planet. I don’t think I have ever had to deal with someone as bad as her ever in my life.

Just ranting…sorry…

So if anyone has any info. or advice I would really appreciate it.
