Taiwan compatriots and working on Mainland

Hello,

Hartzell, let me know if this is off-topic…

I am a dual ROC - USA passport holder. I do not have an ID card in Taiwan (but do have an ID card number).

I live in the USA right now, but will probably have the opportunity to move to Shanghai to work for a privately held foreign company.

My question is, is it easier to work on the Mainland with a Taiwan Compatriots Card (台胞證), or just have my employer apply for a Z-visa under my US passport?

Thanks!

I don’t get the impression that Hartzell has any relevant experience to be able to offer advice on working in the Mainland . . . . . however, I would assume that in order for him (or anyone else) to even consider your question, you need to specify your “time reference” . . . . .

In other words, is your question given from the point of view that
(1) the ROC has already recovered the Mainland,
(2) the PRC has already seized Taiwan,
(3) the PRC has already split into nine separate countries, and Taiwan has already declared independence,

or whatever . . . .

My question is completely practical, and not theoretical.

So to answer your question, the time reference would be:

  1. Status quo. 900,000 Taiwanese live and work in Shanghai under some sort of legal framework.

I did some research, and it does not seem to make a difference whether I get a work visa under my American or ROC passport.

Well, according to what the PRC says, Taiwan belongs to them . . . . . hence, logically speaking, and from the point of view of the legal framework in a civilized country, of course Taiwanese would have free work rights in the PRC.

I hope that you will agree that my analysis is completely practical, and not theoretical.

I agree it is practical, until I get my ass thrown out.

Some people argue that the U.S. Constitution never explicitly authorized taxes. It’s fine and dandy until they get thrown in jail for tax evasion.
