My wife and I own two apartments. One we live in and the other one is almost finished being constructed that we were planning on using as a rental unit. The apartments are under her name because I had a difficult time just to have my name included because I was a foreigner. She paid the initial deposits on both units but I have been paying the mortgages for both for some time now. When we get a divorce is it safe to assume that they will automatically be given to her since they are in her name?
If you can prove that you paid most of the mortgage, you may win in the court, and get the appartment back under your name. The name is not the only concern of the right. Who pay the money is also the concern.
