NOVEMBER 18–Claiming that he has been unfairly branded a “douchebag” in the book “Hot Chicks with Douchebags,” a Las Vegas man has filed a libel lawsuit against the volume’s author and publisher. Michael Minelli, a 27-year-old club promoter, claims that the inclusion of his photograph in the book has subjected him to “hatred, contempt, and humiliation” and has resulted in “friends, acquaintances, coworkers, employees, and strangers alike” calling him a “douchebag.” As seen below, Minelli’s photo appears on page 202 of author Jay Louis’s book, which was published in July by Simon & Schuster. In the book, Louis noted that Minelli’s “popped-collar, spikey-haired presence was so far beyond regular douche, so far beyond uberdouche, he could spontaneously create a new element on the periodic tables–Douche Nine.”

This case may define douchebag legally for the first time. Possibly it may end with Mr Minelli being declared a douchbag ipso facto in court.

There is an old story (almost definitely an urban legend) that some guy called his neighbor an asshole, and the neighbor sued (or pressed charges) him for slander. The guy offers evidence in court of the neighbors past actions, and demonstrates that the neighbor was in fact an asshole. Since slander must be false, he walked on the charge.

That has almost happened in the UK

In 1998 he brought and lost a libel action against the BBC show Have I Got News For You, suing over comments made in a book based on the show published in 1996, which read: “…given Mr Allason’s fondness for pursuing libel actions, there are also excellent legal reasons for not referring to him as a conniving little shit”

They made a joke about this on the show after he lost that it is now legally acceptable to call him a “conniving little shit”.
