I switched jobs recently, and I still had 7 days of annual leave at my old job which was paid out to me in cash. I was wondering, are these kinds of ‘annual leave cash refunds’ taxable or are they treated as tax free?
It’s tax-free if it doesn’t exceed 46 hours/month.
I got paid about 56 hours in 1 month (but those hours were for the whole year).
I wonder if that counts

The unused annual Leave settled in cash is not taxable.
According to the Ministry of Finance’s (MOF) Taishin Taxation No. 16713:
If the number of unused annual leave follows Article 38 of the Labor Standards Law and Article 39 of the same law, the unused leave pay settled in cash shall be exempted from the calculation of the employee’s income tax. However, if the company’s annual leave days are superior to the Standard Labor Act, only the statutory minimum leave payment is tax-exempt, while the superior portion settlement is taxable.
