Can't renounce NZ citizenship

It seems that it is impossible to renounce New Zealand citizenship, unless you first hold the citizenship of another country. Of course Taiwan requires that you first renounce citizenship before you can get ROC citizenship.

Thus, it is impossible for a NZ citizen to become an ROC citizen, unless they are already a dual citizen. (Australia apparently has a workaround for this, but as far as I can tell there is no such proviso in NZ).

So there go my hopes that following govt-attache’s acquistion of ROC citizenship and reaquisition of UK citizenship, I might be able to do the same thing for NZ.

I think there is an exception for citizens of countries that don’t allow their citizens renounce.

國籍法

第九條

外國人依第三條至第七條申請歸化者,應提出喪失其原有國籍之證明。但
能提出因非可歸責當事人事由,致無法取得該證明並經外交機關查證屬實
者,不在此限。

This says that if you cannot obtain certification that you have given up your original nationality through no fault of your own and the Ministry of Foreign Affairs agrees, you are exempt from the certification requirement. My understanding is that this provision is primarily to help Japanese citizens, but it sounds to me like Kiwis might also be eligible.

Feiren, I just noticed that, but it almost seems to good to be true. Seems to suggest that Kiwis can become ROC citizens without renouncing.

The English version of the Nationality Act states:

If you go through with this I would suggest you contact the local New Zealand representative office about renouncing citizenship and obtain an official statement from them denying your request for renunciation and the legal grounds for the denial.

Bu Lai En - I think jlick is quite correct.

I even got a statement signed by the Ministry of the Interior as proof that the para (supplied by jlick) is 100% correct - sort of official verification if you like.

Why did I bother getting it? - it was useful in getting back my UK citizenship. It was one of the main “proofs” they wanted (as well as a letter from a local law firm saying the same).

Its funny, but the first time I approached the MOI for such a letter, they curtly refused. Of course, if you tell them you want to use it to get your citizenship back, they get all emotional and unprofessional, and bascially tell you to take a hike.

I was expecting this, so I told them a semi-truth, (or another perfectly legitimate excuse as to why I needed it) which was - I might be refused a visa if I go back to my (former) “old” country - & this has actually happened to US cizitizens who have renounced - because they mijght say “wo bu ai guo” (i don’t love my country etc.).

On that basis, i was givient the MOI verification letter. (It took 2 attempts - the 1st time I was refused point blank - the secound time I spoke to a Tong Xiaojie who was delighted to help me. Shows hoe f**ked up the system is. But it is certainly do-able).

So looks like you can still achive your objectives - good luck
