I currenlty have marriage arc, I am now in a situation where I will likley lose the marriage arc and so I was thinking of taking a job here in hopes they could offer me a work arc.
I could also enroll in a school, but I know that time doesnt count towards the 3 years. and I think most schools require a health check, which might mean I would have to do two health checks (one for school and one for a new arc)
Basiclly, I will lose my current arc and would like to stay on the island with as few health checks as possible (I really hate the blood draws)
no, you don’t need a health check to change arc to work based, and you can do it in Taiwan. the years on marriagr based arc and work based arc can be conbined if there is no gap.
depending on the types of jobs, you may need a health check to get a work permit, which you need to apply to change your arc from marriage to work.
you cannot change the arc to study based in Taiwan.
i don’t know how long it will take between the divirce registration and the cancelation of your arc, but once your arc is canceled, you should leave within 10 days.
if you don’t want to leave Taiwan, you shouldn’t sign before you can change the arc.
If you really want to stay in Taiwan it’s probably easier to just not sign divorce papers and go your separate ways, apply for APRC/naturalise when eligible, then sign the divorce papers
Also your ARC number won’t change (unless you have the old style ARC number then it will be updated to the new format)
I was nearly divorce here last year so have been through the same thoughts.
As long as you entered into the marriage in good faith, your spouse has virtually no way to divorce you without your permission and disrupt your immigration status. When naturalising or applying for APRC you just need to be married, not in a happy or functional marriage.
Article 24 of the draft amendment of immigration act may be relevant in those cases.
If a foreigner applies for residence or changes the reason for residence, the Immigration Agency may not grant permission under any of the following circumstances; if the permission has been granted, the permission may be revoked or revoked, and the alien residence permit may be cancelled:

8. There are sufficient facts to believe that he does not live with the dependent object without justifiable reasons, or the statements and evidence concerning the authenticity of the marriage are inconsistent.
Interesting, thanks for that. It would be more logical to just allow one sided divorces rather than change the immigration act but then again Taiwan isn’t the place of logic
Justifiable reasons is open to interpretation ‘your law does not allow a one sided divorce and my Taiwanese spouse doesn’t want to live with me and I don’t want a divorce’ would that be justifiable?
Also marriage authenticity doesn’t equal a happy marriage… you’d probably need to lawyer up if it came to this but seems like they’ve deliberately made it a judges call
