Contract Abandonment Penalties

The biggest question I have about these is, are they legal?

The school I am at sucks. It’s a standard buxiban and I hate it. It’s the type of one where they want you to entertain kids and keep the parents happy at all costs. I would like to work for one that is strict and boots kids out for the slightest infraction.

The school has a clause in the contract that states that if you do not finish the full year, you must forfeit half a month’s salary, around 30,000 NTD. I have heard that this is illegal. Is this the case? Are they able to do this legally? If I decide to leave, will I be able to cite a specific law showing them this is illegal and what action can I take to make sure that I recieve my full pay?

It is illegal. However, it is common. Some get the money back via the CLA, some write it off.

The best advice I can give is leave after pay day. However, you would need to first find a new school to sponsor your work permit.
But be aware. 99 percent of the buxibans are exactly how you describe.
