I moved to Taiwan in March this year and I am currently residing here under a Gold Card.
Last Friday, I was stopped by the police and tested for driving under the influence of alcohol. The breathalyzer result showed 1.0 mg/L. During the police questioning and the subsequent hearing with the prosecutor, I admitted to the offense and took full responsibility for what happened.
I had only been driving for about 2 minutes before I was stopped. There was no accident, no one was injured, and no property or vehicles were damaged.
I would like to ask for advice regarding the possible legal consequences in my case and how this might affect my Gold Card status or future stay in Taiwan.
Thank you in advance for any insights or guidance you can provide.
What is wrong with you? Why do you just give everything to the police? Did nobody ever teach you to not talk to the police? Court is for finding out your true culpability, not the police station and NOW you ask about your consequences?
Maybe consult a lawyer and see your chances of not getting a criminal record from the DUI?
From doing a Google search, above 0.15 mg/L is illegal. Since you are a first offender and there was no accident, it may not result in imprisonment according to Google:
“Criminal Penalties: Repeat offenders or those causing accidents may face imprisonment.”
Imprisonment - it may result in deportation and revocation of ARC
Renewing ARC - I don’t believe they do criminal background check
APRC - they require Taiwan police background check. It may not be possible if something shows up.
Yes. That is a lesson which I will never do it.
I dont know why I have done it.
I been out in the town and I took a taxi. My girlfriend closed the door and did let me it. I went to sleep in the car and the apartment doormen have not let me to sleep in the car and I think I left to find a parking place where to sleep.
Citizenship? No idea. Renewing your Gold Car? No idea. Permanent residency? Most likely fine. A DUI is retarded and irresponsible, but I’m not going to flog you over it. I hope you learned from this and never do it again. You are going to pay a good chunk of cash and put it behind you. This won’t show up on your criminal record, but the government will want to know if you apply for PR.
Despite it being really dumb to confess what you did to the police, it was the right thing to do. Police are not your friends, but you fucked up, so own up to it. Might even work in your favor in the future. Shows you “immediately showed remorse” blah blah.
