Fraud case... even if not between Taiwanese accounts (or even in Taiwan for the matter)

Long story short, my aunt and uncle are going on a petty revenge spree and pressed charges against my entire family, including me and now I’m busy trying to get on the phone with the police department with my broken Chinese over allegations of fraud.

I don’t even know what fraud she’s talking about. I’m a Taiwanese national yes but I don’t even have a Taiwanese bank account and never received any money from her from a Taiwanese bank account. My entire life is in the US and I’m pretty much as ABC as you can get. But, apparently that doesn’t matter because I received a police summon anyways.

They’ve taken the step of blackmail too by telling my mother to pay them $10,000 and sign off her inheritance or they won’t dismiss the charges against me. Prior to pressing charges against me, they wanted me and my sister to fly back to Taiwan within 4 days to apologize for something that we had said a year ago or they were going to sue both my and my mom for fraud. Their kids have gone on the offense making fun of my mental health, calling my family thieves, and even threatening to kill me.

Since this is a false allegation against me, can I sue for civil defamation and receive compensation for the time and energy it is taking me to deal with all this nonsense? I just want this to be over with.

  1. you are in the US, have never stepped foot in Taiwan?
  2. summons sent to your US address, or?
  3. was what you and sister said recorded in any way?
  4. did you record their threats to you?
  5. how old are their kids? your blood cousins?

It’s very easy to sue somebody in Taiwan.
You don’t pay other sides costs if you lose.
Fire away , best way is to fight back.

Common tactic in Taiwan is to open spurious cases to drag you to court and spend money.

  1. I’m in the US but I have visited Taiwan in the past but for very short, brief periods of time (<1 month).
  2. Summons were sent to my grandma’s house as I have no residency there. I don’t even have access to the health care system anymore.
  3. They’ve been telling my aunts and uncles to call my sister and mother with these threats. My sister has a saved Line message from my aunt saying that my uncle will withdraw if we apologize.
  4. They are my blood cousins both in their 20s and residing in Taiwan.

That’s honestly what they’re doing here. My entire family lives in the US but with 3-4 cases each, my family has to fly back and forth and get lawyers for everything. It’s ridiculous. At one of the cases, my uncle even self confessed to the prosecutor that he had nothing to sue my sister on but sued her just because she sued him for slander. I didn’t even have anything to do with their family for the last 2 years and suddenly I get dragged in as well. I barely speak Chinese and I can’t even read or write it.

  1. how big is the inheritance for your mom that they are “offering” U$10k to rescind lawsuit?
  2. grandma (mother of that aunt or uncle where your address is) know about this? Should you get her involved if she is blood related.
  1. The inheritance is between 1-2 million dollars as she owns several properties in Taipei. It is to be split between 5 daughters though so realistically, it’s really not even that much money.
  2. My grandma knows about everything (and even sent white candles to their house as a symbolic FU after finding out). I really don’t want to get my grandma even more involved as she’s in the early stages of Alzheimer’s and the last thing I want for her is more stress and anger.
  1. that “offer” of $10,000 is USD, right?
  2. the inheritance amount is converted also in USD? that’s about USD 200,000-400,000 per aunt (including your mom)?

Yup.

that’s a lot of dough.
counter-sue to retain that inheritance (if it’s guaranteed to your mom)
you need a lawyer for sure

It’s a lot of money.
