Under Taiwanese law it doesn’t have to be a false statement to be slander or defamation.
He meant public insult. You can be sued for public insult in Taiwan even if the insult is true.
In this case, the bus driver publicly insulted him by telling other passengers that he publicly insulted him.
If anybody wrongs you in any way in Taiwan, you’re supposed to take it straight to the relevant authorities, and not publicly tattle on them to random citizens.
Well there you go. Sue the bus company and the bus driver then. When the driver stopped the bus I am sure some of the passengers were watching. If they spoke in support of the bus driver then good luck with trying to claim the bus driver slandered you. Maybe some of the passengers also recorded the incident. You never know who records on their cell phone’s.
One of them turned towards me and made the rude gesture to ask me if doing that was ok. They clearly hadn’t witnessed me do it, so the bus driver must have told them.
Urge a little caution here, there is a time limit to bringing charges, AFAIK it’s 180 days but you should confirm with your lawyer, it would not be unheard of for the other party to file on the very last day. You should have your lawyer prepared and ready to go on day 179 in case you receive a last minute notice of filing otherwise you lose the safety of having a counter case.
Yeah, I was told 6 months by the police, so that makes sense.
What if I move house? How do I get my mail forwarded so I can receive that on time?
Your lawyer is best placed to advise you on this, and indeed all the other questions you raised.
I have first hand seen several times a middle aged local man or woman while running chasing the bus, got left behind by bus.
Even he/she only late by seconds.
Usually, they will wait really old man/woman walking with cane or maid though.
Have seen people stuck inside an express bus that skipping some stops until it arrived on final destination.
It is really the bus driver discretion.
I have seen some drivers that refuse to open the door because they left the bus stop, moved 10 feet, and sitting at a red light that still has over 1 minute while others will still open the door.
So ya, really depends on the driver. But not opening the door is probably the SOP.
Sue that mofo
The money you get from her goes to the bus driver. The bus driver pays you some back because he got in your face.
You and him go for a whiskey to celebrate.
I’m not sure how serious you’re being, but if I’m on camera flipping him off, wouldn’t suing be a terrible idea?
I would think so. Same in reverse.
Mutually assured destruction. That’s why Kuo told you they can’t sue. It’s MAD.
But you didn’t do anything to the passenger who flipped you off.
Seems like a separate case between you and her.
I’m not sure why people are making such a huge deal out of this. I doubt the bus driver cares anymore.
You flipped him off then were a nuisance when trying to get off the bus, it’s not the end of the world.
You didn’t attack anyone or steal something, worst case you were a pain in the ass.
I wouldn’t worry about being sued or arrested just try to be calmer next time.
It doesn’t seem to have been on the local news yet, not sure if that is a good or bad sign !
What if I wait till the last possible second and file something against him?
Do you really want to be that guy? I’d say you’re already lucky to be out of jail.
Most people on this forum wanted to help you get out of a bad situation. This comment of yours doesn’t help you. It makes you sound vindictive and petty.
I’m not going to do it. It was just a thought.
If you were the bus company, you dont think they have thought of that possibility?
If the bus driver reported this altercation to management, which I guess he did since police were involved. One of the first things the management will do is evaluate the risk and potential liability you now represent to the company.
This is what they do for a living in management, I can almost guarantee you every scenario you can think of has resulted in multiple court cases for the company.
