That’s a lie to the court. Surely that is it’s self a crime.

The statement re assets was supplied by the tax office, not the court. You go there with your court decision and they supply details of the assets of whoever the lawsuit names as the loser.

So she also lied to the tax office.

It’s no exaggeration to say she lies to everyone. I think one very damaging incident in the high court was when she was caught in a blatant lie to the judge. After I questioned whether the supposed substitute for my hours was a bona fide teacher she added a bunch of evidence specifically to refute my claim. However, in the oral debate that followed, when I pointed out that no tax deductions were listed for this teacher on the salary sheets supplied, and the judge picked up on this, she said: “Well that teacher only comes in very infrequently…” and the judge snapped back, “You supplied evidence that she’s a teacher who works full-time in your school…” Cue lots of moaning about me to escape the topic.

I would say the hardest part to deal with though, and the decisive difference between being a defendant and a plaintiff in the two lawsuits with her, was that in the labor court where she was defendant, she could not benefit from fabricating evidence, whereas as plaintiff I found it really difficult to cope with the fact she fabricated and altered much of her evidence. One claim was based on whited-out surveys, supposedly from parents, which had comments (written by the plaintiff) which I proved she had altered as the lawsuit developed. She was ordered by the judge to provide the original, unredacted copies of these and continually postponed doing so with a variety of excuses, until finally saying she didn’t have them. What was so wearing is that she used this as the basis for a claim of 750,000TWD. Having that hanging over my head for two years was exhausting. I found it inexplicable that the court would not tell her to supply the original material or abandon her claim, as they did with other pieces of evidence.

Out of curiosity, I am guessing all documents, testimonies, court proceedings, etc are in Chinese?

Used books aren’t worth much. You’d need to own a place that allowed you to resell them and even then you’d get nothing back.

Most businesses operate as shell companies in order to protect their assets. You succeeded by suing the business owner and achieving a court imposed ruling that allowed you to go after their personal assets.

I worry that your ex boss is in the process of asset transfer although her ability to be able to do that without raising suspicion of the court, or better still being found in breach, is much harder now. I believe that’s why she provided a minimum payment and promissory note. As argument that the case is settled. This will then allow her to transfer assets to avoid further payment and leave the onus on the court to take responsibility.

Suing a person and suing the court are two very different matters entirely.

Only English is in some of the documents making up the evidence. Incredibly time-consuming having things translated for me, then my writing a filing in English, having that translated and then the lawyer working on it.

Her last legal option to have the judge’s decision overturned, an appeal for a rehearing, failed. I danced with joy when I got the news today.

In the last few weeks, she has:
Lost a labor lawsuit to me for 230,000TWD
Lost her own lawsuit, with the money I owe her reduced from 100,000TWD to 20,000TWD. She was asking for 1.3 million TWD.
Had her personal assets frozen and a property she rents scheduled for taping up prior to public auction. She had the taping up postponed by paying me 75k of what she owes, but her property remains frozen.
Received notification that 3 parcels of land she owns will be taped up for public auction in 2 weeks.
Lost her appeal to have the labor lawsuit reheard. (This will have cost at least 30,000TWD to prepare, I reckon.)
She’s also about to get a notification that all of her clan must appear in court to disentangle ownership of a property.

Great question. I won’t know until I get the judge’s full decision, which should be quite soon. The 100,000TWD I was told to pay her in the district court decision was for violating a clause of my contract that had a penalty for that amount by being absent/absenteeism/absent without permission (the judge in district court decided I was absent on the day I quit, even though I was a) at the school 45 minutes before I was due to begin work, and b) had clocked in.)

I got a call from the clerk today. He finds it terribly amusing that he can’t pinpoint where the land is, seems it’s in the middle of a forest somewhere and is next to worthless. May switch tack and go looking for where they park their car.

A lot of families have random bits of land. A great, great grandfather had some land. Divided between five kids, then between 25 grandkids and so on. Ends up being worthless unless they all get together to sell.

Where is this land in Taiwan? And when and where is this auction?

She appears to have given up and has gone to the Bureau of Labor Insurance to apply to pay the rest of the money into my pension account. Considering her intention to pay me nothing at all, this counts as a great victory. Even if 230,000TWD isn’t that much really, she stole it from me and has had to hand it back.

The land office has detailed plans available, you just need the lot numbers. If it’s a watershed area than it’s as good as no value.

Good 4 u. Some expats/foreigners would say this is a blow for US, but I consider that standing up for ones rights creates the pressure of precedent to cause change/progress for the TW legal system (or whatever country), even if it is a cm at a time. Therefore locals should be a little bit grateful that we are the squeaky wheels here sometimes. Lots of social progress in the US (my main experience) was from various minorities/new immigrant groups/disenfranchised groups created lots of positive civil rights change that also benefited myself in various ways.

Hope your prev mentioned countersuit goes well and that she should also have to apologize publicly. People like that would literally rather die (or kill you) rather than go through with that. Old evil auntie would probably have a stroke (or fake one) should it come to that.
