Marrying to an American

Can somebody please tell me,

  1. What documents will be needed when you want to marry an American ( If you are a Taiwanese)?

  2. How to prepare those doucments?

  3. After how long of the marriage, the Taiwanese wife can work in the States?

  4. Whether it is a good idea to apply for a tourist visa to go to the States first, and get married in the states afterwards. Or, get engaged first and apply for the fiance

Once you are married to a US citizen, your US citizen husband can file a petition on your behalf for permanent residency status (green card). There is no waiting list or quota for spouses of US citizens and thus the time it takes before you receive your green card will be very short… only as long as it takes to process the same.

    1 depends where you get married

If in Taiwan a US citizen needs a statement from AIT saying (s)he isn’t married a tw needs a copy of their household register I think. if in USA it would depend on state law. Some places may require some things, others not. A place like Las Vegas requires nothing except ID I think. In China, Chile, or other countries I have no idea.

It really depends on your decision where you want to get married as what sername1 mentioned.

  1. Do your parents permit both of you to be married in US?
    Then you can apply for K-1 Visa (Fiancee Visa). You need to provide supporting documents e.g. (letters, emails, pictures, etc.). All supporting documents must proof that both of you are engaged. When they approved of your status, they shall give you 6 months visa. After that you guys need to get married within 6 months period in United States.

  2. Do your parents want you to be married in Taiwan then only you are permitted to go to US with your spouse?
    Then you need to apply Spouse Visa (Immigrant Visa). There are two stage: -
    i) First petition, where you need to proof of your marriage certificate. If it is not in English, you have to translate it and get certified. Shall you past, then they will give you second package.
    ii) The second package, will need you to do medical checkup and police clearance record and your spouse financial record/affidavit of support.
    iii) When you pass these 2 stage, the embassy will give you 6 months visa for you to fly to States.
    iv) Within 2 months you are in States, the INS will arrange an appointment for you to be interviewed to get your conditional green card.
    v) Your conditional green card expires in 2 years period. You have to renew it 90days before it expires.
    Take Note Americans: Please check whether you need to have a single status for you to be married in Taiwan.

Of course! (it’s cultural)

You should only apply for the green card if you intend to live in the USA. If you are planning to continue living in Taiwan, there is no need to apply for the green card.

It might be cultural but it’s not legally binding… You do not need parents permission if you are of legal age to get married.
