Hello, would anyone be able to estimate how much a lawyer would cost with contesting a will in taiwan?
Let’s assume the estate you want to contest has a house worth NT$9 million and NT$1 million in a bank account.
In Taipei, the lawyer fees after all appeals might very roughly range from NT$350,000 to NT$1.5 million. The lower end would be if you can speak Mandarin well and went with a less seasoned lawyer. You will not be able to recover these fees. Very few Taiwanese lawyers work on contingency.
You also need to consider court fees and security for attachment.
As plaintiff, you will need to pay 1% of claimed amount in advance or NT$100,000 in court fees if you reside in Taiwan. If not, they will be higher.
You will also need to be able to put up security to attach the property to avoid fraudulent transfer. This is 1/3 of your claim. So about NT$3.33 million in this case. You can get this security back.
