‘Online’ Bank’s xenophobic reasoning for denying "foreigners" the ability to open an account online

What a load of shit. So the FSC doing nothing to uphold the rules doesn’t infringe your rights?

Does this technically mean that you weren’t allowed to appeal? (As opposed to you having appealed but the original decision - or lack of a decision - was upheld.)

On another note, how long have you (and @comfy123) typically needed to wait between a bank responding to an FSC complaint and the FSC itself responding? It’s been two weeks for me now, and the FSC also hasn’t answered a second message I sent a week ago chasing things up. Is that normal?

Correct, there was no standing

It really depends on the bank, they can be fast or can be slow. DBS took 1 month to send me a reply, but they fix the stuff in the meantime

No, I mean between the response from the bank and the response from the FSC. After the bank responds, the FSC should send something, right?

What we were talking about here:

Also, is that even correct? See Article 2 of the Administrative Appeal Act:

Anyone who’s right or interest was unlawfully or improperly injured by a center or local government agency’s inaction to his application according to Acts during the period stipulated by this Act is entitled to file an administrative appeal as well.

Need to read better tmr, just came back from Europe and the brain is not exactly at its best

I expected that type of reply. I also expect the same inaction by the control yuan as well. They seem to have no oversight when they do things, and one department tends to wash the hand of the other.

@Andrew suggestion might be worth exploring, will check better today. They sent a follow up letter saying that I have like 2 weeks to appeal again if not satisfied.

Don’t you get the impression that these people are just making up bullshit excuses each time to avoid doing anything? I do.

I think now I’ll be making sure to mention that Article 2 bit when I inevitably need to file one…

ok, now I read better, so there are 3 reasons for disqualification:

  1. not a case of infringement of rights due to an action of the agency
  2. cannot be accepted under art. 2 due to expired period of the inaction, since it must be appealed within 2 months.
  3. the application has not been submitted in Chinese, so against art. 98 of the Administrative Appeal Act. Everything must be in Chinese.

Well, let’s try to the control Yuan, will send everything in Chinese this time.

How long was it between the lack of action and your complaint? I thought you did it pretty quickly. Would there be grounds to extend the period because of waiting to hear back from the FSC about the unclear process or something? Article 15 (this is pretty unclear English, maybe the Chinese version is better):

An administrative appellant files an administrative appeal to the agency with jurisdiction of administrative appeal after the administrative appeal period stipulated in last Article was expired due to act of god or other caused not contributed to her/him may file an application to restore her/his original status via a written which prescribes the reasons why act after the date is due within 10 days after the reasons were demolished. However, it is not allowed to do so while the date of administrative appeal period expired is over 1 year.
One who file an application for restoring her/his original status shall take action which is required to do according to the administrative appeal process within the period at the same time.

Couldn’t this run into the same problem, with them claiming you didn’t follow the correct appeals procedure so it was appropriate to reject it?

have no clue, will try anyway for the science. I am quite tired mentally, the EMBA course is taking its toll on me

Nice … humble brag …

didn’t say where, so can’t brag. can even be at a scam online uni for what u know.

I guess so … and you might never graduate. Thanks for taking this the right way, by the way. Appreciate that!

I always try to be nice to ppl haha.

that haunts me man, the ROI would be very bad if that were the case…

Both Taiwan Co-Operative Bank and Taishing Bank called and replied to me within a week or so of my FSC complaints.

coz they saw u as a citizen, so they had no excuse of “no English service available” BS, and they get to it.

Good point. Yes China Trust lass when I complained was she told me I was a foreigner because she called me in English and refused to accept my Taiwan ID and after the FSC complaint has never spoken to me in English again. I got my CC limit increased. Also when I uploaded my HSBC HK bank statements she said sir my supervisor says your annual income is not very high. I’m like did he realize its a net annual six figure USD income and not HK$ income. What? She says, a bit stunned… I’m like yeah it’s a multi currency account but income is paid in US$ The statement is in Chinese and English is it not? Please differentiate between HK$ and US$ as it might make a difference.

Taishing Bank have actually approached my issue the best. The chap said the IT dept has been instructed to change the citizenship application for Rikart Bank to allow English characters and to allow putting nothing for elementary school education as did not study in Taiwan. He said they will do this by December and he will call me back when it’s done.

But what I’m asking is that there should be a response from the FSC after this, no? That’s the part I’m wondering about, because I haven’t heard anything two weeks after the bank responded.

If the bank respond and address your issue they most likely notify the FSC. If they respond and do not address your issue then you file another complaint.
