Re-applying for Taiwanese passport under an American one

Hi

I have both Taiwanese and American citizenship
I’m currently in Taiwan under my American passport, with hardly any proof of ID.

My mother is holding both my passports, and refuses to release them.

I have my highschool diploma, an expired taiwanese national health insurance card, and a photocopy of my taiwanese passport.

Would it be a problem getting my American and Taiwanese passports re-issued? Can I even get them to give me a Taiwanese passport since in the records I exited the country and never came back?

What documents would I need to apply?

Is there anyway I could make my mum give my passports back?

You are being very cryptic in your replies. There are a number of persons who post to these forums who have significant knowledge about Taiwanese laws and regulations.

However, by failing to provide us with a full statement of the circumstances, and how this all came about, we are unable to give you much in the way of advice . . . . .

How old are you? If you’re an adult, then it would be against U.S. and ROC law for another person to hold your passport.

I am in Taipei, as is my mother.

I’m eighteen, which makes me an legal American adult, but not a completely legal Taiwanese adult.

Tell you mother you need your passport as ID to get a library card or something. Then simply don’t give it back to her. I could be wrong, but I believe its technically illegal to be walking around the streets of Taiwan with no form of ID.
In fact, that gives me another idea – tell mum that you got busted for jaywalking and you have to bring ID to the police station.

Just curious by why would your mother refuse releasing your passport to you if you have good reason for taking them? Is she afraid you’ll leave the country or something?

File a lost passport report with the police and take this to AIT with whatever ID you can muster - preferably a photocopy of your US passport and a US birth cert if you have one.

You could also search the house and steal your passport back if you know it isn’t in a safe deposit box somewhere.

I heard of cases like this. It is usually when the kid is a trouble maker that this happens.

But if you an adult by USA standards you can go to the AIT and just claim you lost it and file the proper paper work.
