I’m curious, can you get deported in this situation? Then come right back on your other passport and give the cops/staff who deported you the finger.
I don’t know the answer but it sounds exactly like the way Taiwan operates?
Maybe you could go to NIA and ask them to change your status? They do this for people who naturalise for example
Do you mean if I overstayed or got caught working illegally? Yes.
Can I simply re-enter as a citizen? Yes.
Do I need to give anyone the finger? Only if I want to be charged with an offence.
NIA said I can enter as a foreigner and be given a new Tax ID number.
He never shared it with me, btw
A national with household registration isn’t an alien… the provisions of the act dealing with foreigners and entry permits refers to aliens.
You might be able to get away with it but it likely wouldn’t be legal. Also, the act requires nationals with household registration (specifically) to present their travel document for inspection.
This is one of those things that probably isn’t going to work as soon as you do something that gets you into trouble with the state. The fact is that you’re a national with HHR… I doubt that entering with a different passport is going to convince a judge that you’re magically not one.
but how can they show that you is you without papers and if legally the TW u is out of the country?
Depends if they already know who you are, or hist have the suspicion but haven’t connected the dots yet… oh look here’s a TW national ID with the same person in the photo and the same birthdate etc.
It’s mostly a question of how much resources the state is willing to throw at proving who you are. In the majority of cases they probably just don’t care / are too lazy. But if they wanted to, I don’t doubt that they could.
Please this has been asked an answered in other threads. There is no requirement for a citizen to enter Taiwan on an ROC passport. ROC Citizens can and have entered on foreign passports and can be granted ARC’s. They only cannot be granted an APRC.
Now do not claim that is not legal as it is. Dual citizens are allowed to enter on foreign passports but they are then treated as the foreign national. Totally legal. I could travel to Australia, leave my ROC Passport in Australia and fly to Taiwan using a foreign passport. Totally legal.
Which law says that a national entering on a foreign passport is not treated as a national?
You are showing you do not understand the law. Read through the thread as it has been discussed and answered before with the law links showing it to be legal.
Only citizens who area of military age who have not done conscription must enter on an ROC passport. If they enter on a foreign passport they can be barred from leaving until military service is completed.
All other ROC citizens can enter and leave Taiwan on a foreign passport and as such are treated as the nationals of the passport they use.
Its not suspicious for an ROC citizen to enter on a foreign passport. My son’s mother does this when she comes here from Australia. She enters on her Australian passport even though she is a citizen here. You seem to think doing so is not legal.
This law. It allows ROC citizens to enter as foreigners then apply for ARC’s and live in Taiwan as any other foreigner does.

This is roc nationals without household registration… not roc nationals with household registration
I’m not saying it’s suspicious, and I’m not saying you’re not allowed to enter on a foreign passport.
The law (article 93) allows nationals to enter on a foreign passport and have the provisions of the Immigration Act concerning aliens apply to them, but it doesn’t say they stop being a national… nor does it say that other laws pertaining to nationals don’t apply either.
Read the link I posted directly above its how citizens with HHR can apply for ARC’s. I am not talking about NWOHR passport holders.

Any ROC citizen currently residing in the Taiwan Area who has entered Taiwan with a foreign passport and is applying for residency, or an extension of stay shall first register with the Household Registration Office his/her place of residency in the foreign country, before the NIA may accept his/her application.
ARTICLE 17
The act applies to them being aliens… They can get an ARC, they can get a tax ID number as a tourist. If they enter as an alien they are treated as one. They can be fined and deported if they overstay. They can only overstay as they are not seen as being citizens when entering Taiwan on a foreign passport. By law entering on a foreign passport means you do not have the rights of a citizen. Citizens with HHR can enter on a foreign passport, be treated as an Alien and get an ARC. Gold Card Holders can do so if their HHR was de activated for living overseas aka Steve Chen, Youtube founder citizen of ROC.
That link doesn’t seem to be a “law”, and the page text isn’t loading for me either:
As discussed previously, I think you read too much into these unusual cases that the government doesn’t seem to have a consistent policy of dealing with, which has often led you to some wild conclusions like that people can split into multiple people.
I think you’re interpreting it more broadly than the actual wording of the law.
It says that the provisions of the Immigration Act concerning aliens applies to you (so yeah you can get an ARC etc), but it doesn’t say that you are an alien, nor that you stop being a national, nor that other laws concerning nationals doesn’t apply.
