Here’s a question. If you can pull this off do they then cancel your household registration???
No one is claiming you stop being a national or citizen. Where did I write that anywhere? However under the law you are a foreign national for all respects including taxation, domicile, etc.
If I can pull this off? It is part and parcel of the immigration law. It’s not some dreamed up fantasy.
It can become in active. Like my ex wife who lives in Australia. She has no domicile in Taiwan as she does not live here and stays less than 30 days a year and enters Taiwan on her Australian passport or Taiwan passport. She uses either one. This year my NWOHR son and his HHR mom entered on their Australian passports.
I think this is the right answer lol… unusual cases in Taiwan get lazy laws.
There is no lazy law. The law is very clear that ROC citizens with HHR entering on a foreign passport are treated as any other alien and are subject to the same rules as apply to those entering visa free, or on a visa, and to those applying for an ARC. If I wanted I could enter Taiwan on a foreign passport and apply for a JFRV. However I don’t want to change all my phone banking and other details to an ARC lol.
Allowing a citizen to enter their country on a foreign passport doesn’t change the fact that they are a citizen.
However for consular reasons they are then treated at the nationality used for entering. For this reason some countries do now allow dual citizens to enter as foreigners. Taiwan UK and other countries do. So there are legal differences.
I cannot ask for Australian consular assistance in Taiwan as I have not entered on an Australian passport. I cannot go to an EU office for support being an ROC citizen.
Nonsense
Not nonsense. As a citizen here the government here has no obligation to inform the Australian government if I was arrested for a crime. The Australian office would have no right to ask to be given access. Now they may say OK we grant you permission but it’s not a right. You might want to learn about a countries consular rights to access.
You’re implying this when you say you “are a foreign national for all respects”.
The law does not say this. I think you’re being loose/careless with the wording. The law says that certain provisions of the Immigration Act (and only the immigration act) applies to you. But you’re still a national with HHR for the purposes of any provision in any law that concerns nationals with HHR.
You cannot get consular assistance in a country that you’re a citizen of regardless of the passport you used.
No I am not. That is in your own mind. I never implied anything like this at all.
The passport used and consular protection only applies to third countries that you are not a citizen of.
That is not true. If I enter on an Australian passport I can get Australian assistance as I entered as an Australian citizen. Each country can refuse to recognize the citizenship of the foreign country. Australia US etc require citizens to enter on their Aus / US passports to avoid this issue. So they do not have to give access to a foreign government for a dual citizen.
I should know being a trained consular officer with DFAT before. Let me know what consular training you have had.
Even if you entered on a foreign passport, your access to consular services from the government of your foreign nationality may be limited because you’re also a national of the country you’re in. This is a very common warning to dual nationals travelling to their home countries.
Yes but they enter their home countries on their home country passports which is why they are denied consular rights. Many countries do not recognize dual citizenship. It also is why people with dual citizenship may flee to a country that does not allow their citizens to be easily extradited for crimes.
So even for Taiwan, if a male enters on a foreign passport and have HHR they can be refused exit and have to do military service in Taiwan. There is a special stipulation in the law for this.
Many a time people have entered their other country of citizenship on citizen passports then asked for help from the foreign country they reside in to be told no help available. Just the same as citizens of countries with dual citizenship cannot be forced to leave where they live and do military service in another country of citizenship.
Anyway this has nothing to do with the fact that I can enter Taiwan on a foreign passport as a tourist subject to the same visa rules for foreigners.
Seen that I have never been fingerprinted at an immigration check point I can decide with foreign nationality passport to use. After all they all have different passport photo’s, a different name, and all have place of birth written differently. country only, city & country, or just suburb born in.
Just hope that Taiwan’s government doesn’t read Formosa ![]()
It would not matter if they do. Nothing nefarious about having multiple nationalities with different names. Many people do so.
Can someone remind me what this thread is actually about?
Guy
It says that the provisions of the Immigration Act concerning aliens applies to you (so yeah you can get an ARC etc), but it doesn’t say that you are an alien
Sure it does. On your ARC. Alien Resident Certificate.
