Take action against Taiwan bank tax residency tax certificates

Global bank…

The funny thing is, that email probably went up a rung before being sent out, so at least two HSBC employees have likely seen it and thought it was watertight.

Exactly

HSBC does. HSBC Taiwanese staff on the other hand… HSBC obviously tries to trust its local staff but it seems that the Taiwanese they hired are not being given clear guidance by both the FSC and the NBT

All this does not reflect well on the Taiwan regulator does it?

The regulator is shit. They say that they take a “hands off” approach. But “hands off” simply means… “we have no idea so we’re leaving it up to you”

Taiwan is so cute when they try and play international finance.

They tried to make me sign such a declaration also at HSBC HK when I opened my account at the central branch like 4 years ago. So it’s not only TW, even “world” class HK fucked up tbh.

Silly question but was it clear you were only a Hong Kong resident at that time?

Yes, not PR, but have been living in HK for almost 2 years at that point.

When they say they’re the world’s local bank, they mean it.

This might have changed, but many years before most people claimed residency in Australia on a WHV and got it granted. There were a few requirements. I know for sure because I did it and even helped others to fill out the tax form. The tax return from withheld was quite large.

There was a court case about it a few years ago so it may have changed.

Definitely has changed, just checked

Tax Rates as a Working Holidaymaker in Australia

Whether you get the visa subclass 462 or 417, you will always be considered a non-resident, which will be used for tax purposes. Backpackers were once considered as residents in Australia for tax purposes. However, it is no longer the case in the country.

Anyone who stays over 183 days in Taiwan are considered tax residents… Even those who were on those endless waiver extensions who went over 183 became tax residents…

But those on working holiday in Taiwan are tax residents of Taiwan if they stay more than 6 months even though they don’t get an ARC (except Brits)

Try convincing any employer or bank of that. I couldn’t even get hired legally

That’s because they have been considered as “foreign residents” under court decision because their intention is to stay on a “temporary basis”. Thus my argument with some on another thread who claims we are all “foreign residents in Taiwan.” APRC holders are here on a permanent basis and therefore are “LOCAL RESIDENTS”

Migrant workers in Taiwan are “foreign residents” as they generally do not intend to live here on a permanent basis.

The problem is that there are those in our community that are blurring the lines by classifying us all as “foreign residents in Taiwan” which is not true.

Not much point rehashing this. You know what people are referring to when we say “foreign residents”, and you can find a lot of precedent to support either our interpretation or your interpretation of the term.

Most of the stuff we’re discussing here affects both APRC holders and ARC holders, who are both “residents” (or can both be “residents” - there are situations where people can have an A(P)RC without being tax-resident here or here permanently).

I don’t think this is a useful division to introduce, even though it’s a division the Taiwanese government likes to use to restrict the rights of these workers. Many migrant workers also stay here multiple years, and most of what we’re discussing in this thread isn’t much affected by whether someone has the intention to stay here permanently. A lot of regular ARC holders from richer countries also only live and work here for a few years without planning to be here forever, but for the period they’re living and working here and only legally tax-resident here they still have the right to be treated as such.

Also send that to the FSC. That’s the banking supervisor. They might bite.

Don’t hold your breath over it…

Remember the saying. “All bark and no bite?” The FSC don’t even bark…

I was just thinking that earlier actually. Good idea. Just done it!
