Renditioning Khalil to Louisiana before anybody knew what was happening was a genius move on the part of the Department of Hate Speech. If there’s any place a brown-skinned foreigner can get a fair trial in the U.S. it’s Louisiana.
NEW YORK (AP) — Mahmoud Khalil will remain detained in Louisiana until at least next week but can finally speak to lawyers while they fight the Trump administration’s plans to deport the Columbia University graduate student for his role in campus protests against Israel, a judge decided at a hearing Wednesday.
The brief hearing, which focused on thorny jurisdictional issues, drew hundreds of demonstrators to the federal courthouse in lower Manhattan to denounce the Saturday arrest of Khalil, a permanent U.S. resident who is married to an American citizen.
Khalil, 30, was not brought to the hearing from an immigration detention center in Louisiana, where he has remained after a brief stop at a New Jersey lockup.
After Khalil’s Manhattan arrest, Judge Jesse M. Furman ordered Monday that the 30-year-old not be deported while the court considers a legal challenge brought by his lawyers, who want Khalil returned to New York and released under supervision. For now Furman is letting Khalil remain in Louisiana.
Isn’t that ultimately what is being addressed? Don’t come here just to stir up shit and join or create a NGN or non profit, use US tax dollars to further causes that seem to be set against US principles/rules.
I’m thinking about the no profits set up to “help” the migrant train illegally crossing the southern border, showing them the safest trails, how to surrender to ICE and border patrol-- all while taking tax dollars.
If there weren’t such non-profits sending money and knowhow to Hamas, via Palestinian “aid groups” I’d be very surprised.

It’s pretty hardball - not allowing private convo w/lawyers until ordered to by the judge. Taking him right away to Jersey and then Louisiana to avoid a trial in Manhattan. However, there’s a supreme court ruling from early aughts determining a defendant’s right to trial in the jurisdiction he was detained.
Trying to frame his political activity as premeditated (meaning before he came to US to study).

Apparently in immigration law details can remain private but I think secrecy will backfire in the public court of opinion, both ways - the wife remains a mystery too, for example.
The flyers or pamphlets might be problematic, but as the so-called leader(don’t know the details on that) can he be held accountable?
If it doesn’t all get thrown out I imagine there will be interesting legal challenges coming from both sides.
I seem to recall a lot of people not being happy about the violent and pro Palestinian/ anti Israel protests on college campuses. And the university presidents having their say in congress don’t go all that well either.

Many of those unhappy people voted for the guy who won. I believe you had no problem with a democratically elected president regardless of who won.
Can people democratically vote for a harder line on immigration from the executive branch? Seems that yes, they can. We seem to be having a Rights vs Structure situation wrt to this guy.
The rights side will argue as you have that free speech is one of the founding principles and should be protected regardless of who is talking and also now, in this case, regardless of said person’s residency status . A structuralist might say yes, that entrenched principle is very important and by defining what is and isn’t protected speech (all speech is clearly not protected) we strengthen not only our democratic principles but our institutions as well by letting the system work through the case.
Idk if free speech is as self-evident as the founders thought it was, or it the majority has shifted into a new perspective on the issue.
It’s a good case to bring to court though.
Having a GC is not the same as being a naturalized citizen.
Maybe the best thing that can happen for the cause of free speech and immigration law is for the guy to NOT be released. Let the case move forward— otherwise, what have we learned?
US border czar Tom Homan called Khalil’s arrest “justified” while also threatening to increase the number of ICE agents in New York and other sanctuary cities during a wide-ranging press briefing on Wednesday.
“It’s a direct violation of our foreign policy objectives. When you hand out leaflets, incite violence on a college campus, that’s illegal,” Homan said while flanked by Republican lawmakers in Albany, New York.
Trump administration lawyers filed a motion to transfer or dismiss Khalil’s habeas corpus petition late Wednesday, arguing that the Southern District of New York is “an improper venue” and has no jurisdiction over Khalil’s case.
The administration argued that because Khalil was physically present and detained in New Jersey at the time the petition was filed and the court “did not acquire habeas jurisdiction over this matter.”
The motion also explicitly states that if the judge considers transferring the case to New Jersey, the administration “respectfully preserves the right to argue” that Khalil’s case be transferred to Louisiana.
Khalil’s defense has until midnight Friday to respond.
I won’t defend Mahmoud Khalil’s despicable views, but I will defend his rights. Though he supports movements and individuals who deny rights to those they oppose, we are not like him.
We live in a country governed by law—or at least, we are supposed to. If Khalil is to be deprived of his liberty, it can only be through due process of law. We defend his rights because if his are not secure, neither are ours.

Based upon the postings of his group, Columbia University Apartheid Divest, Khalil, who was born in Syria, seems to hold grotesque opinions. CUAD, which helped lead the anti-Israel protests on Columbia’s campus, has cheered the October 7th pogrom that saw almost 1,200 Israelis killed and thousands more maimed and wounded, writing, “The act of Palestinian resistance on October 7, known as the Al-Aqsa Flood, breached Israeli security and made significant military advances,” adding that it was “a day that will go down in history.” CUAD crowed that the October 7th attacks would be remembered as the “crowning achievement” of Hamas leader Yahya Sinwar, because the “Al-Aqsa Flood was the very essence of what it is to resist ‘with what we have.’” Not a word of condemnation for the deaths of innocents, the rapes, the immolation of whole families, nor the kidnappings.
CUAD has lavished praise on other terrorists and enemies of the United States and Israel, like Ismail Haniyeh and Hassan Nasrallah, leaders of Hamas and Hezbollah respectively, which gives you a flavor of the movement. And while some members of the organization at first distanced themselves from a student, Khymani James, who posted an Instagram video telling university officials that “Zionists don’t deserve to live,” and “Be grateful that I’m not just going out and murdering Zionists,”
Maybe he’ll be forced to admit he was talking shit, that this was just that old prog standby: Rhetorical Advocacy.
