At the risk of getting OT, what’s a non-fixed term contract? I just got an APRC within the time of my current one-year contract, so there is any benefit or drawback to having that over a fixed term contract?

It’s a contract with no predetermined termination date, i.e. a permanent contract. You can use LSA Art. 15 to terminate without penalty, and your employer needs a reason to get rid of you (i.e. can’t just fire you on a whim – at least not legally).

The LSA has two types of contract, fixed, which is supposed to be used in only a few circumstances, while the rest are non-fixed. However, even if you sign a fixed contract, there are conditions which, if met, mean the worker’s contractual relationship will be deemed a non-fixed one.

(But again, a foreigner without an APRC would be one of those “few circumstances”.)

It’s a contract from the Civil Code, aka contract of mandate. It’s true application is for appointing someone to carry out something on your behalf, but some schools try to frame foreign teachers’ work in this way, solely to escape employer obligations laid out in the LSA.

And it’s not just schools doing it!
