This is where you are at fault and you need your insurance company to compensate the other party. Where you have the minimum mandatory insurance and the other party is at fault, your insurance company will not go to bat for you.
To demonstrate the value of paying a little extra for your insurance ~ I was hit by another driver earlier this year, my insurance company called me the next day and told me I can just go and get the car fixed as soon as I like. They’ll cover the cost before even waiting for the accident report. The accident was found to be 100% the other drivers fault, there were no injuries, my insurance company will either get compensated by his company or sue him but I don’t have to worry about any follow up. If it was 100% my fault I also wouldn’t have to worry about it as my insurance will take care of it all (up to 50KK NT$ or so) even to the extent of a 50K NT$ red envelope to give to the other party if they are hospitalised to “smooth the rest of the process”.
He may be 20% at fault. However I believe he has already messed it up by paying some of the medical expenses and not notifying his company…
I have the same for my car. Expensive but worth it. → It also gave my girlfriend the confidence to start driving. She got her license but was too scared until I explained my coverage.
Also one thing to be mindful… don’t purchase the online insurance unless only you and your wife or close family member drive. The online insurance policies don’t cover friends or even girlfriends… No. I didn’t learn the hard way but rather I read the terms and conditions when I was about to purchase it… I then called the company to confirm - who told me that it was some legal limitation and if I came to their branch they could do it without the limitation at no extra cost…

True, my “default” insurance covers my wife however I added a little extra, maybe NT$100 and now any licensed driver is covered to drive however, and this one is important, they’re only covered to mandatory third party level and not the same coverage I have.

Don’t worry about that for now. He will definitely need to pay more for the damages to your scooter than you need to pay for the damages to his.

Got hit by his car, died. ‘Poor’ guy, no property, never paid a dime. Actually no other vehicle involved, person killed was walking.

My partner was riding our Yamaha Smax 155 towards Taipei (淡水方向). Approaching a small pedestrian crossing with a blinking red traffic light, he slowed down and stopped at the pedestrian line due to sun glare. He looked left and right to ensure it was safe to proceed. The stop lasted about 4–6 seconds.A car passed on the left while he was stationary. There were no pedestrians present.
When he noticed its clear 4-6 seconds in he was starting to drive off when the rear scooter driven by an elderly couple (although there was ample enough distance) was speeding and rear-ended our scooter, causing damage to our vehicle and injuries to both drivers.
Our scooter sustained: broken taillight, broken left rear indicator, CVT/engine area damage with oil leak, deep scratches on body panels, and handlebar/footrest damage with a quote of about 18.5 k . We also had to replace our KYT helmet which really protected my partner! The elderly man’s scooter sustained significant damage: broken mirror, front bumper, front wheel rim, punctured tire, broken cheap helmet which he btw hadn’t clipped when riding.
My partner had minor sprains on hand and foot and went to McKay Memorial Hospital for treatment. The elderly man cracked his head, lost consciousness and also split his hand between his fingers.
We are currently waiting for the 7 day period to obtain evidence, have contacted our insurance ( compulsory insurance via Fubon) & also collected medical certificates on the day of + follow up checkup & YSP Quote. I was posting here to share the incident as it goes and also to see if anyone has similar experience. Also to double check regulations regarding blinking red light stops.
Oh also : the red light (traffic light) isnt visible in the dashcam nor restaurant footage. What’s visible is a decelerating stop 4-6 seconds and during which we are clearly seen as rear-ended.
Legally speaking, a flashing red light in Taiwan is treated exactly the same as a Stop sign.
So you should be at (mostly) no fault, since you followed the traffic rules and were hit from behind.
In your case your insurance will take it on with the other side, because the other party had bodily injuries.
The accident report should have all the details about the intersection situation and traffic lights collected by police on site after the accident.
