That’s just an excuse he should edge out slowly if he can’t see, you can’t blame an obstacle.

If you don’t know its safe you wait.

The responsibility rest with the person pulling out not the vehicle making their way down the road.

we still don’t know his speed, you don’t get tunnel vision, you just have less time to react to things around you.

again we don’t know how fast he was going, but you should always ride within the law and your ability which ever one is the slower.

Based on how the entire bike ended up inside the car… I’d say he was going very fast.

That was my first thought, but then I realised he went through the back door and rear window onto the back seat.
He has flipped and come down on that quarter, wight off the bike, him plus momentum hitting that column, lucky if he didn’t get cut in two.

Also the entire car was flipped around from the momentum of the crash… no way he was going under 180 at that…

As the name states, ‘Monster’. Really for beginners.

I’ve done that with a tree, I pulled out of a street in fog, slowly. Couldn’t see the other vehicle as sight was obscured by a tree. The other car hit me on the front, I was fully in my right as I was actually standing still at the moment the other car hit me, he was at fault as you need to be able to stop for any obstacle at any time.
Your speed need to be according to the circumstances, and being able to stop at any time.

and you know his minimum speed form looking at a photo on the internet.

I’m just playing devils advocate as we don’t have the information.
He may or may not have been going fast, I’m not qualified to say.
The car turned around when it was hit in the back end when it was already turning.
If the car was speeding out of the junction and turning left it would be unstable anyway.

but my point still stands

I don’t know if a 50-60 km/h Ducati can do that to a Mercedes.

This is considering that Mercedes are pretty well built…

he hit a stationary vehicle, if your pulling out into traffic the responsibility is up to you to make sure it’s safe.
In fog he should have seen your lights and driving for the weather conditions. sounds like you had a better lawyer.

I saw a car almost hit an ambulance pulling out of a nursing home, the car was going way too fast for the road (a small alleyway) and the ambulance has its lights on. The driver of the car even honked at them. Ambulance always has right of way by the way if the light is on.

It’s a modern car, they are all designed to fall to pieces in an accident.

It’s a Mercedes, if the car were to fall to pieces the passenger compartment is designed to be very strong to protect the passenger. Plus they are known for being a well built car that can survive even a fairly heavy collision that would have totaled other cars.

They have right of way but can only go when safe to do so, same for police and fire.

Would you prefer Ducati “M600” (or whatever size the engine is)?

It most definitely is NOT a high performance track bike

My beginner bike was a Yamaha Seca (600cc if I recall correctly). Never owned/ridden a Monster but had a 750SS which was also NOT a high performance track bike but a little more aggressive than the Monster I believe

It don’t matter how strong the car is, its hit the car on a weak point. as stated above my first reaction was he must have been going fast, then I saw how the bike has come down on the car then thought he’s lucky he’s not cut in half. but I still won’t try to guess what speed he was doing and will go back to my point.

Maybe the idiot was the one who made a baseless assumption…

in this case, i mean the mercedes driver could have just gone into the road without looking. happens down here all the time, morons just driving into traffic without stopping and looking.
